Copyright and Legal Requirements:
Clients agree to assume all risks and responsibility for copyright
issues. It is presumed that all licences or permissions, that
may be required under applicable national and international leglislation,
have been obtained from the copyright holders or regulating bodies,
prior to submitting the materials for work required.
Generally, copyright legislation allows an individual to make
or to have made, copies for his/her own use, provided the originals
are owned by the individual. Material recorded prior to 1947 *may*
be in the public domain and thus be free from any such restrictions.
It is always recommended that reference to competent legal counsel
be made where there is any concern about these issues.
It is legal to make a copy of a copyrighted sound recording as
long as both of the following two conditions are met:
1. You own the original source recording (it was purchased or
created by you), and
2. You will keep the copy for your own use and agree not to distribute
it for profit.
If you are the copyright owner or the work is in the public domain
there are no restrictions.
The copyright laws allow the person that has purchased a musical
recording to make a copy of the music they purchased on a different
medium. For example, it is legal to buy a CD and then record it
onto a cassette to listen to on a portable walkman. It is not
legal to give or sell the cassette to someone else.
Furthermore, copyright laws will allow copies of a recording
to be made for archiving or safekeeping. Often you will see this
on copyrighted software, and the companies even advise making
a copy for in case the original copy gets damaged.
Our policy is to perform restorations and transfers in one copy
only. For multiple copies we require that the work be in public
domain or proof of copyright.
Soundrestoration.com specifically prohibits the use of our professional
restoration and remastering service for the purpose of duplicating,
distribution or re-distribution, publishing, broadcasting, netcasting
or any other form of digital or analog copying and/or distribution.
We monitor and enforce compliance.
